<b><span style='font-weight:bold'>DUTIES AND RESPONSIBILITIES</span></b><br>
The Statute of the International Criminal Court establishes an internationally
new and unique system for the participation of victims in proceedings before
the Court. In addition, the Statute also provides victims with the right to
apply for reparation for the harm suffered as a result of crimes under the
jurisdiction of the Court. Due to the complexity of procedures governing the
functioning of the Court, most victims will need to be legally represented and
assisted. Private counsel may be appointed and paid for by the Court but the
funds for financial assistance for victims’ legal representation will be
limited. For the purpose of assisting victims with regard to their
participation in proceedings and obtaining reparations, the Regulations of the
Court provide for the etablishment of the Office of Public Counsel for Victims
that falls within the Registry solely for administrative purposes and otherwise
shall function as a wholly independent office. In performing their tasks for
the representation of victims, the members of the Office will act
independently. <br>
<br>
Under the supervision of the Principal Counsel, the incumbent will perform the
following duties:<br>
<br>
- Provide victims and legal representatives of victims with legal assistance
and support in accordance with the Statute, the Rules of Procedure and
Evidence, the Regulations of the Court and other applicable rules, including
legal research and advice, resolving procedural and substantive legal questions
and interpreting legal instruments; representation at different stages of the
proceedings both at the seat of the Court or outside the Netherlands;<br>
<br>
- Appear before a Chamber of the Court, as and when required;<br>
<br>
- Produce factual background documents on the situations before the Court;<br>
<br>
- Produce research papers and providing advice on applicable law of the Court
and/or on selected aspects of international criminal law; international
humanitarian law; human rights law.<br>
<br>
- Provide training to junior staff of the Office;<br>
- Participate in training for potential legal representatives of victims,
including in the field;<br>
- Represent the Office at specialised meetings inside and outside the Court on
behalf of the Principal Counsel;<br>
- Performed other tasks as required by the Principal Counsel.<br>
<br>
<b><span style='font-weight:bold'>QUALIFICATIONS AND EXPERIENCE</span></b><br>
Advance university degree in law, with specialisation in criminal law,
international criminal or human rights law, or the rights of victims and
established competence in international or criminal law and procedure, as well
as at least 10 years of experience whether as judge, prosecutor, advocate or in
other similar capacity, in criminal proceedings in accordance with Rule 22 of
the Rules of Procedure and Evidence and Regulation 67 of the Regulations of the
Court. Experience before international criminal jurisdictions would be
considered an important asset. <br>
Candidate should also have an excellent understanding of the norms and
procedures of the Court, including the Rome Statute, the Rules of Procedure and
Evidence, the Elements of Crimes, and the Regulations of the Court.<br>
Excellent drafting and argumentative skills; outstanding oral advocacy;
demonstrated ability to work on a litigation team, preferably with members from
different criminal justice systems, with demonstrated experience in preparing
and conducting complex and large-scale criminal cases or cases involving
international crimes. Ability to work under stict deadlines. Interpersonal
skills and communication skills; strong analytical and computer skills. Tact,
discretion and accuracy in handling confidential information. Availability to
travel in the field. Ability to establish and maintain effective working
relations in the Office of Public Counsel and with the representatives of
different legal and cultural background.<br>

Fluency in either of the working languages of the Court, English or French, is
essential. Working knowledge of the other is desirable. Knowledge of another

<b><span style='font-weight:bold'>FONCTIONS ET RESPONSABILITÉS</span></b><br>
Le Statut de <st1:City w:st="on"><st1:place w:st="on">Rome</st1:place></st1:City>
établit un système nouveau et unique en son genre sur le plan international
permettant la participation des victimes aux procédures de la Cour. En outre,
le Statut prévoit aussi que les victimes aient le droit de demander des
réparations pour les préjudices subis du fait de crimes relevant de la
compétence de la Cour. En raison de la complexité des procédures régissant le
fonctionnement de cette dernière, la plupart des victimes auront besoin d’être
assistées et représentées sur le plan légal. La Cour peut nommer des conseils
extérieurs et les rémunérer, mais les fonds alloués à la représentation légale
des victimes seront limités. Aux fins d’aider les victimes à participer aux
procédures et à obtenir des réparations, le Règlement de la Cour prévoit la
constitution d’un Bureau du conseil public pour les victimes, qui relève du
Greffe uniquement sur le plan administratif et fonctionne comme un bureau
totalement indépendant pour le reste. Dans l’accomplissement de leurs tâches
consistant à représenter les victimes, les membres du Bureau travaillent de
manière indépendante.<br>
<br>
Sous la responsabilité du conseil principal, le titulaire du poste remplit les
tâches suivantes :<br>
<br>
- Fournir aux victimes et à leur représentant légal une aide et une assistance
juridiques conformément au Statut, au Règlement de procédure et de preuve, au
Règlement de la Cour et autres règles applicables, y compris en effectuant des
travaux de recherche juridique, en donnant des avis juridiques, en résolvant
des problèmes juridiques portant sur la procédure et sur le fond, en
interprétant les instruments juridiques et en représentant ces personnes à
diverses étapes de la procédure, tant au siège de la Cour qu’à l’extérieur des
Pays Bas ; <br>
<br>
- Comparaître devant une Chambre de la Cour lorsqu’il y a lieu ;<br>
<br>
- Rédiger des mémoires sur les faits se rapportant aux situations portées
devant la Cour ;<br>
<br>
- Rédiger des mémoires sur les recherches effectuées et fournir des avis sur le
droit applicable à la Cour et/ou sur des aspects spécifiques du droit
international pénal, du droit international humanitaire et du droit relatif aux
droits de l’homme ;<br>
<br>
- Former les employés du Bureau du conseil public pour les victimes ;<br>
<br>
- Participer, parfois sur le terrain, à des formations destinées aux personnes
susceptibles de représenter des victimes ;<br>
<br>
- Représenter, au nom du conseil principal, le Bureau du conseil public pour
les victimes dans des réunions de spécialistes, tant à la Cour qu’à l’extérieur
;<br>
<br>
- Accomplir toute autre tâche à la demande du conseil principal.<br>
<br>
<b><span style='font-weight:bold'>QUALIFICATIONS ET EXPÉRIENCE</span></b><br>
Diplôme universitaire de troisième cycle en droit, avec une spécialisation en
droit pénal, en doit international pénal, en droit relatif aux droits de
l’homme ou en droit des victimes. Compétence confirmée dans le domaine du droit
pénal international et des procédure y relatives. Au moins 10 années
d’expérience professionnelle en matière de procès pénaux en qualité de juge,
procureur, avocat ou autre fonction du même type selon la Règle 22 du Règlement
de Procédures et des Epreuves et le Règlement 67 du Règlement de la Court . Une
expérience au sein d’une juridiction pénale internationale serait un atout.<br>
<br>
Le candidat devra également avoir une très bonne connaissance des normes et
procédures de la Cour, et notamment du Statut de Rome, du Règlement de
procédure et de preuve, des Éléments des crimes et du Règlement de la Cour.<br>
<br>
Excellente aptitude à rédiger et à argumenter. Dons d’orateur exceptionnels.
Capacité avérée de travailler dans une équipe d’avocats, de préférence composée
de membres provenant de systèmes judiciaires pénaux différents, avec une
expérience avérée en préparation et en conduite d’affaires pénales complexes à
grande échelle, ou encore d’affaires portant sur des crimes internationaux. Capacité
de travailler en respectant des délais serrés. Qualités relationnelles et
aptitude à communiquer. Capacité d’analyse et connaissances informatiques
avérées. Tact, discrétion et fiabilité dans le traitement d’informations
confidentielles. Disponibilité pour se rendre sur le terrain. Capacité
d’établir et de maintenir des relations professionnelles au sein du Bureau du
conseil public pour les victimes et avec des personnes provenant de traditions
juridiques et de cultures différentes.<br>

<b><span style='font-weight:bold'>CONNAISSANCES LINGUISTIQUES</span></b><br>
La parfaite maîtrise d'une des deux langues de travail de la Cour est
essentielle (français ou anglais). Une bonne connaissance de l'autre langue de
travail est souhaitée. La connaissance d'une autre langue officielle de la Cour
constituerait un atout. (arabe, chinois, espagnol, russe)<br>
